Warrants and Probable Cause

Judicial Warrants 

  • issued by a state or federal court
  • signed by a federal court judge, state court judge, or magistrate
  • are valid for a specific time-period
  • may have a defined scope

Immigration Warrants

  • are issued by a department or agency
  • are signed by an immigration officer or immigration judge
  • may have a DHS seal, label, and/or the actual form number DHS Form I-200, “Warrant for Arrest” or Form I-205, “Warrant of Removal/Deportation”, or use the word, “alien.”
  • will say their authority comes from law (such as Immigration and Nationality Act) not a court system
  • DO NOT authorize the agent(s) to enter the premises. You may refuse to comply with the warrant and ask the agents to leave

What is “probable cause”

Anything in plain view can give an officer or agent probably cause. An object is in “plain view” if it is obvious to the senses, in a public area (eg lobby, restaurant dining room, what you can see from the visitor’s side of reception etc), as well as sounds within “plain hearing.” Unless the officers or agents have a warrant, they may not move objects to expose other objects or the other sides of an object.

Órdenes Judiciales

  • Expedidas por un Estado o una Corte Federal
  • Firmadas por un Juez de una Corte Federal, un Juez de Una Corte Estatal o un Magistrado
  • Son válidas POR UN TIEMPO ESPECÍFICO
  • Pueden tener una intención específica.

Órdenes migratorias:

  • Son expedidas por un departamento o agencia
  • Están firmadas por un oficial de migración o un juez migratorio
  • Pueden tener un sello de DHS y/o puede incluir el número de la forma I-200 “Orden de detención” o la Forma I-205 “Orden de deportación” o puede traer la palabra “alien”. 
  • Puede decir que la autoridad viene de la ley (Por ejemplo la Ley de inmigración y nacionalidad) pero NO de una corte.
  • NO autorice a los agentes a entrar en donde usted se encuentra. Usted tiene el derecho de rechazar seguir este tipo de orden.

¿Cuál es una causa probable?

Cualquier cosa a simple vista puede darle a un oficial o agente razón de una “causa Probable”. Algo que esta a “simple vista”, si es obvio y claro en un área pública (restaurante, centro comercial, recepción, etc) asi como algo que se pueda escuchar fácilmente. A menos de que los agentes u oficiales no tengan una Orden, no pueden mover objetos en ningún lugar.
