Protesters’ rights

You have the right to ask if you are free to go if you were stopped
on the street by police; if the answer is yes walk away.


If the police say you are not under arrest but you are not free to go know that you are being detained, as in the police are temporarily restricting your movement. During this time the police can pat down the outside of your clothing if they have a reason to suspect you are armed and dangerous.

You have the right to say you don’t consent to a search


The police, however, may continue to do so, and may charge you with assault, battery, or resisting arrest if you resist being unconstitutionally searched 

You have the right to not answer any questions that police ask


you can say, “I’m going to remain silent and I want to see a lawyer.” 

You have the right to refuse to identify yourself, or choose
to only answer with your name and date and birth


If the police ask for identification you have the right to refuse, or to choose only to answer with your name and date of birth. Do not reach into your pockets to show an officer your ID without permission, so they do not overreact 

You have the right to ask for an officer’s name and
badge number if you are mistreated.


You have a right to record police activity when they are
on duty.


The Police, however, could charge you with other things, such as disorderly conduct in order to prevent you from recording

The Chicago Police department can hold you for up to
48 hours without charging you, and during this time
you will not have access to your personal effects.
